Terms and conditions of use

Using the Platform confirms that you understand and fully agree to these Terms. The Platform may only be used if you accept the Terms and Conditions as presented, either by checking the corresponding checkbox on the Platform or simply by using the Platform.

We reserve the right to modify these Terms and Conditions at any time. If we make changes, we will publish the updated version on the Platform and will inform you accordingly, prior to any modifications taking effect, via email and/or by displaying a notification on the Platform.

General considerations

Our mission is to grow a community dedicated to authentic Romanian tourism. We aim to bring together travelers passionate about unique experiences and hosts who offer remarkable locations, promoting a modern and transparent way of traveling throughout the country. To maintain this standard, we follow the principles below:

• We provide our platform and customer service.
• We commit to always respecting and continuously improving our partner selection criteria to offer high-quality accommodations and experiences.
• We cater to people from all over the world, which is why the platform is bilingual—available in both English and Romanian.
• We provide a modern, user-friendly website with the lowest rates.
• We offer a FAQ (Frequently Asked Questions) section for those in need of information. If additional details are required, you can always reach out to us via email at [email protected].
• Those who use the services available on our platform will be able to leave reviews about their experiences. We commit not to censor them as long as they maintain a respectful and appropriate language.

Terms and conditions

1. Definitions

"Hwv.ro", "we", "our" means Amoro Marketing & Sales, a private limited-liability company under Romanian law, with registered office at Buzau, Dorobanti 2, block B12, Buzau County, Romania.
"Platform" means the (mobile) website and applications owned, controlled, managed, maintained and/or hosted by hwv.ro.
“User” refers to any person, at least 18 years old, with full capacity, who accesses the website, being interested in the data, information, announcements and/or services of Amoro Marketing & Sales Srl, as well as any person (including authorized person) and/or legal person who purchases the services provided by the Travel Service Provider (host) through the platform.
"Service provider/stay" or “Host” refers to any individual or legal entity that lists their property on the Platform for promotional purposes. Through HwV, their services can be discovered and selected by Clients in order to initiate the booking process directly with the Host. These services include guesthouses, cabins, traditional houses, and other unique accommodation units. The Host is responsible for complying with the applicable legislation regarding tourist rentals and the operation of accommodation units.
"Account" or "User Account" means the user account that any user must create and login to, in order to use the services/functionalities available on the Platform.
"Content" or "Promotional Materials" means any information made available by Users within the Platform, directly or indirectly, including without limitation profile information and any data collected by the Platform regarding current or previous bookings.
"Service" means any and all services and related functionality that we provide in connection with the Platform.
"Client" means an individual or legal entity that accesses the Platform to discover, view, and request the availability of tourism services listed by Providers.
"Tourist Services" refers to the totality of accommodation offers and related services presented by the Host on the Platform. These are informational in nature and are displayed for the purpose of being discovered by Clients, while the actual booking is made directly with the Provider.
"Stay" refers to the accommodation service package chosen by the Client after reviewing the offers on the Platform. The stay is contracted and paid for exclusively outside the Platform, through direct interaction between the Client and the Service Provider.
"Experiences" refers to special services or unique activities promoted through the Platform. These may be highlighted as distinct offers, with the Platforms role being to facilitate contact between the Client and the Host in order to establish their details.
"Booking request" refers to the message or availability request sent by the Client to the Provider through the tools made available by the Platform, with the purpose of initiating the arrangement of a stay.
"Stay Booking" refers to the process through which a Client expresses their intention to benefit from a Hosts services, using the contact tools provided by the Platform. The completion of the booking, the agreement on conditions, and the payment for the stay are carried out later through direct interaction, outside the Platform.
"Property" or "Accommodation Unit" refers to any tourist accommodation structure presented on the Platform (such as cabins, guesthouses, chalets, manors, glamping sites, traditional houses, or apartments), together with the facilities and specific experiences offered by the Host to their guests.

2. The purpose and nature of the platform

"Hwv.ro" is an online platform (or a computer program associated with a website, available as a Software-as-a-Service (SaaS)), through which Service Providers can promote, sell, or rent out their products and services, and through which Clients can search for and book services/experiences.

The Platform's representatives will make every effort to ensure that the information displayed is as accurate and comprehensive as possible, with the goal of providing detailed and complete information to Users. However, Hwv.ro does not assume responsibility for any errors in the content. Service Providers personally manage and promote their services through our Platform and are fully responsible for the accuracy and correctness of the information, data updates, pricing, or other details.

Our services are exclusively for personal and non-commercial use. No entity is allowed to resell, use, copy, register in different formats, save, or reproduce any content or information available on our Platform for competitive or commercial purposes.

3. Accessing the platform

In general, accessing the Platform does not require the creation of a User Account. However, to access certain Platform functionalities, registration may be required.

A User Account can be of two types: Host and Client/Tourist, and it can only be used after prior acceptance and compliance with the Terms and Conditions displayed in the respective section of the Platform.

To create a User Account, you must fill in fields with personal information such as name, surname, home address, email address, phone number, or other identification details. At the time of account creation, you must be at least 18 years old. Additionally, it is strictly forbidden to create an account using false data or someone else's information without legal authorization.

If there are reports or indications of unauthorized use of personal data and information, we will suspend the account until the issue is resolved, or, if necessary, we will permanently delete it.

To complete the User Account creation process on Hwv.ro, you must follow the instructions provided either on the Platform or via email from the Platform administrators.

By "instructions," we refer to guidance texts, often accompanied by links.

If you suspect unauthorized use of your account or become aware of any security breaches, please notify us immediately at [email protected] or through any of the contact methods available on the Platform's Contact page. Hwv.ro is not responsible for any losses or damages resulting from failure to comply with security obligations or best practices as indicated in these Terms.

4. Content and use of the platform

All information available on Hwv.ro, including but not limited to text content, photographs, descriptions, logos, slogans, documents, media materials, as well as design, infrastructure, technical solutions, and functionalities, are the property of Amoro Marketing & Sales.

It is strictly prohibited to use any of the aforementioned materials in any form without the written consent of Amoro Marketing & Sales.

The Service Provider declares that they own the copyrights to the content published on the Platform, including photographs, and agrees that this content may be made available to Users by Hwv.ro on all its online platforms, as well as through other advertising channels, such as press releases, television, banners, billboards, social media networks, and others.

Additionally, the Service Provider agrees that Hwv.ro may store information such as email addresses, business names, addresses, entity identification details (CUI/CNP, Trade Register number, etc.). This is done for the legitimate purpose of authenticity verification, billing services, and other operations, all of which will be carried out in accordance with the Privacy Policy.

5. Display searches and rating system

To facilitate searches and help users find the right service provider for their needs, Hwv.ro offers various search filters and sorting options, allowing users to customize the search results according to their preferences.

Hwv.ro allows service providers to respond to reviews. We reserve the right to modify, reject, or remove reviews at our discretion if they violate our review policy.

The responsible department within Hwv.ro commits to monitoring and removing reviews that include profanity, personal identification details, political content, discrimination, mentions of other websites, or any other inappropriate content.

6. Service Booking Process

The Hwv.ro platform provides travelers with direct access to the contact information of service providers, facilitating quick and efficient communication between guests and accommodation owners.

Direct contact with service providers. Travelers can check the availability of an accommodation unit and request additional details by directly contacting the owner or administrator. The contact details available on the platform typically include a phone number and the option to send messages via WhatsApp.

Booking through external systems. Some Hwv.ro partners have integrated automated booking and availability verification systems via their own websites or other booking platforms. In these cases, travelers can follow the indicated links on Hwv.ro to quickly check availability and complete their reservation. Please note that national-level competing booking platforms are excluded from this process.

Flexibility and transparency. This booking method allows travelers to access the necessary information quickly and directly, without intermediaries or the risk of overbookings. Availability verification can be done either by directly contacting the owner or by consulting the external links provided on Hwv.ro.

7. Rates

On the Hwv.ro platform, rental rates are set and managed exclusively by service providers (accommodation owners) and are displayed on each unit’s presentation page alongside other relevant information.

To ensure transparency and competitiveness, service providers are required to list and practice their reception rates (the lowest available rental prices) on the Hwv.ro platform. This policy aims to offer travelers the best possible rates while strengthening Hwv.ro's position in the booking market.

The rates displayed on the Platform are for informational purposes and include VAT or other local taxes, unless otherwise specified by the Host. The final cost details will be confirmed directly by the Service Provider at the time of booking.

It is the users responsibility to carefully review the listing details, including service descriptions, pricing structures, usage conditions, booking policies, and any restrictions before finalizing a reservation.

Policies related to pricing, payment procedures, check-in/check-out rules, cancellations, delays, refunds, and overbooking management are established and managed exclusively by service providers. Hwv.ro does not intervene in these processes; its role is solely to facilitate the connection between travelers and property owners.

The currency converter available on the platform is provided for informational purposes only and does not guarantee exact exchange rates at the time of payment.

If the platform offers special deals—such as last-minute promotions, holiday discounts, or other campaigns—these will be distinctly marked to ensure easy identification by users.

8. Free Access for Tourists

The use of the HWV.ro platform is free for tourists, who have unlimited access to the available information and the services provided by service providers.

Service providers (accommodation owners) benefit from the listing and promotion of their units on the HWV.ro platform by subscribing to one of the available plans, which are determined and agreed upon with HWV.ro. These subscriptions include various services and benefits aimed at optimizing the visibility and accessibility of their offerings for tourists.

Subscriptions must be paid in advance at the time of listing on the HWV.ro platform for a period of either 6 or 12 months.

To ensure transparency and competitiveness, service providers are required to display their reception rates (the lowest direct rental prices) on the HWV.ro platform.

9. Payments and Booking Processing

HWV.ro is not involved in any financial transactions between tourists and service providers. All payments for bookings, additional services, or associated orders are made exclusively between the tourist and the service provider (the owner/administrator of the accommodation unit).

Payments are made using the methods established by the Service Provider, based on the payment details agreed directly between the tourist and the Provider.

By using the contact tools available on HWV.ro, you interact directly with the chosen Service Provider. Any confirmed reservation represents a contractual agreement concluded exclusively between you and the Host. HWV.ro does not intervene in the transaction, payment, or cancellation process and assumes no responsibility for the commercial terms agreed upon between the parties. Any request or dispute related to the stay or payment will be resolved directly with the Service Provider.

HWV.ro does not collect banking details and does not process payments. For any transaction made directly with the Host, please follow your banks security protocols and report any unauthorized use of your card to your bank.

10. Cancellation/modification policy

HWV.ro only provides users with the contact details of service providers (owners/accommodation units) and does not have any direct involvement in the booking, cancellation, or modification process.

All actions regarding cancellations, modifications, or any other decisions related to a booking are carried out exclusively between the tourist (the beneficiary of the tourism services) and the service provider (the owner/administrator of the accommodation unit). HWV.ro is not responsible for any misunderstandings or conflicts that may arise between these parties.

Cancellation and modification policies are established by each service provider and are available on the listing page of each accommodation unit under the designated section. Service providers are required to keep this information up to date so that tourists are informed before making a booking.

It is important to note that any booking, cancellation, modification, or any other action derived from a reservation is conducted outside the HWV.ro platform and represents a direct and exclusive contractual relationship between the tourist and the service provider.

Any misunderstandings, conflicts, or disputes that arise either during the booking process or after the stay has been completed must be resolved exclusively between the tourist (the beneficiary of the tourism services) and the service provider (the accommodation owner). HWV.ro has no involvement in such situations and cannot be held responsible for such disputes. If the parties cannot reach an amicable agreement, dispute resolution falls under the jurisdiction of the competent authorities in accordance with applicable law.

11. Special Cases of Booking Cancellations

Apart from the common cancellation cases established by each service provider, there may be exceptional situations where a booking can be canceled. All such cases are managed exclusively between the tourist (the beneficiary of the tourism services) and the service provider (the owner of the accommodation unit), without the involvement of HWV.ro.

Special situations that may lead to booking cancellation:

• - The tourist does not show up at the accommodation for check-in and does not inform the service provider in advance about a delayed arrival.
• - The tourist cannot be contacted by the service provider to confirm the booking due to incorrect or inaccessible contact details.
• - The service provider has clear evidence that the tourist will not honor the booking and will not arrive at the accommodation.
• - The tourist has not made the payment for the services within the deadline set by the service provider.
• - At the time of check-in, the tourist fails to pay the remaining balance (if only a deposit was paid). In this case, the service provider must report the cancellation in writing.
• - The tourist provided false or misleading information during the booking process.
• - There is evidence that the tourist intends to use the accommodation for illegal activities or purposes that do not comply with the rules set by the service provider.
• - The tourist is involved in legal incidents or under investigation for offenses committed during the stay.
• - Force majeure events, including natural disasters, government restrictions, economic sanctions, or other unforeseen circumstances preventing the normal execution of the reserved services.

The Importance of the Direct Contractual Relationship Between the Tourist and the Service Provider

HWV.ro has no involvement in the booking cancellation process, modifications, or disputes between the tourist and the service provider. Any issues, conflicts, or misunderstandings must be resolved exclusively between the two parties.

If the parties cannot reach an amicable settlement, disputes will be resolved by the competent authorities according to the applicable legislation.

12. Rights and obligations of Service Providers

Rights

Use of the platform at will, for the purposes for which it was developed and made available to users: browsing, researching, accessing all account-specific functionalities, purchasing, ordering, or booking services presented in the platforms sections.

You may maintain a single listing per accommodation, but you can have multiple listings for a single property if it has multiple accommodation units. Any experience offer is subject to our additional terms for experience hosts.

As a host, Holiday with Views grants you the right to use the HWV.ro platform to make your accommodation services available to all platform users in relation to tourism experiences or other hosting services.

If you would like to showcase your property on our platform, you can submit a listing request which will be manually reviewed by the Holiday with Views team. To maintain the high standards of our community, we carefully select each property and reserve the right to decline certain requests.

Once accepted on the platform, you will have full control over how you manage and present your property.

Obligations

As a service provider, you declare that you hold all necessary authorizations and licenses for offering services from your partner/host account and that you are fiscally registered according to national laws.

Service providers must enter complete and accurate identification details in their user accounts (according to the available fields), including the type of business entity (VAT payer/non-payer), as this information will be used for invoicing, bank transfers, and other operational activities.

As a service provider, you are responsible for determining and fulfilling your legal obligations to report, collect, remit, or include in the price any applicable VAT, indirect taxes, occupancy taxes, tourism taxes, income taxes, or other levies.

Each service provider is allowed only one user account, and creating multiple accounts using the same information is prohibited.

It is strictly forbidden to promote services within the platform using texts, descriptions, or external links that compete with HWV.ro. Additionally, service providers are not allowed to post or publish photos containing inscriptions or graphic elements (logos) belonging to competing websites or platforms.

When you are contacted for a booking through the platform, you enter into a direct agreement with the guest. You are responsible for honoring the services according to the rates and conditions presented in your profile at the time of the request, unless you and the guest agree directly on other specific details.

Service providers promote their accommodations and tourism services on HWV.ro based on monthly subscriptions paid to HWV.ro. These subscriptions provide visibility on the platform, promotional opportunities, and other benefits aimed at optimizing exposure and attracting clients.

Your listing on the platform must include complete and accurate information about your services, rates, additional fees, policies, and any other rules or requirements applicable to guests or bookings.

You are responsible for your actions and omissions, as well as for maintaining up-to-date and accurate information in your listing, including content such as photos. We encourage you to carefully review the terms and conditions and policies, including details on exclusion from the platform.

The service provider is responsible for their own acts and omissions, as well as those of anyone they allow to participate in service provision and management. You are responsible for setting prices and policies and must clearly describe all relevant details in your listings.

The rates displayed on the platform must reflect the standard online reception rates set by the service provider, ensuring a competitive pricing plan unless otherwise agreed upon in writing via contract, postal correspondence, email, or other forms of written communication.

We encourage best practices and advise against sharing your account access details with third parties. HWV.ro is not responsible for incorrect information, booking management, or other related situations resulting from such actions.

You are required to manage your listed services on the platform in full.

The service provider is solely responsible for the accuracy of the information provided as a host. HWV.ro does not assume any responsibility for the information provided, particularly regarding the right to accept a booking or grant access to your services. Additionally, the service provider is solely responsible for overbooking situations.

Mentioning other web domains on the service listing page is strictly prohibited.

The platform may not be used for any illegal or unauthorized purposes, nor for engaging in, encouraging, or promoting any activity that violates these terms or any other rules or policies established and communicated by us to the service provider.

HWV.ro does not allow copying, reproducing, selling/reselling, or exploiting any portion of the platform without prior written approval from HWV.ro.

Activities such as phishing, cracking, hacking, or other similar actions that endanger the platform, its users, the hosting server, information security, or any other platform-related elements are strictly prohibited.

13. Correspondence

By making a reservation, you confirm that you agree to allow us to use the email address or phone number provided when creating your account to send you an email or SMS confirmation from the host regarding the availability of the service you have shown interest in. We recommend keeping the reservation confirmation at least until the end of your stay (checkout).

To avoid any communication errors, please ensure that you correctly enter your email address and all other required information on the platform.

Hwv.ro may use the contact details provided during registration or booking (email address, phone number, home address) for sales-related activities (for example, in relation to bookings) or for other advertising purposes. Hwv.ro may discontinue the use of your data and the sending of notifications upon written request from you.

14. Liability

Hwv.ro is not responsible in any way for the quality of the services provided by service providers, even if these services are listed on our platform and have been booked using our platform. Therefore, you acknowledge and understand that any claims for compensation must be addressed directly to the service provider.

Additionally, the service provider (host) assumes full responsibility for the quality of the services, as well as for the accuracy and truthfulness of the information published and promoted on the platform.

On the platform, service providers can interact directly with tourists.

15. General terms

Hwv.ro has the right to verify, through legal and independent means, the authenticity and quality of a service provider's services before entering into a partnership with them.

We reserve the right to delete and/or partially modify data published on the platform, without prior notice, if we determine that it violates the Terms and Conditions in any way. This includes but is not limited to content that is discriminatory, racist, offensive, defamatory, constitutes unfair competition, infringes upon the intellectual property rights of a third party, or goes against good practices, negatively affects our platform, or violates any applicable legal provision.

Additionally, platform administrators have the right to modify and/or delete content from listings if it is found that service providers have added incorrect information, low-quality content (such as grammatical errors in accommodation descriptions), images containing phone numbers, logos, branding elements, or other information deemed inappropriate.

Hwv.ro reserves the right to remove or suspend any service provider from the platform without prior notice, for an indefinite or permanent period, if they commit any of the following violations:

• - Failure to pay for subscriptions or other services owed to Amoro Marketing & Sales
• - Violation of the platform's terms and conditions
• - Failure to comply with the required quality standards
• - Engaging in activities that defame or damage the reputation of the platform
• - Any other actions that result in financial or reputational harm to Hwv.ro

The tourism service provider (host) may be informed/notified by email in the event of removal or suspension, with an explanation of the reasons behind the decision and the contractual or legal provisions that were violated.

16. Governing Law, Jurisdiction, and Dispute Resolution

These terms and conditions and the provision of our services will be governed and interpreted in accordance with Romanian law.

Any dispute arising from these terms and conditions and our services will be submitted exclusively to the competent courts of Buzau, Romania. Consumers of the services have the right to file a claim in the courts of the country where they reside. Conversely, any action against a consumer may only be brought before the courts of the country where the consumer resides.
